

Globus Medical (NYSE:GMED) sued Johnson & Johnson (NYSE:JNJ) yesterday for patent infringement, accusing its DePuy Synthes unit’s Zero-P VA spinal implant of trespassing on a Globus patent.
Filed in the U.S. District Court for Delaware, the lawsuit alleges that the Zero-P VA intervertebral fusion implant violates U.S. patent #8,328,872, for an "Intervertebral Fusion Implant," assigned to Globus last December, according to court documents.
Globus wants a jury trial, a judgment of infringement, a judgment of willful infringement (and the accompanying triple damages), injunctions barring further infringement, damages, interest and legal fees.
Audubon, Pa.-based Globus also wants the Delaware court to order Synthes to recall and destroy any devices found to infringe the ‘872 patent in the U.S.
