Supremes decline review of Stryker loss to Hill-Rom

The U.S. Supreme Court today declined to take up an appeal by Stryker in a patent infringement lawsuit against Hill-Rom Holdings.
A federal appeals court in June overturned Stryker’s win in a lower court decision, ruling that the district court misconstrued the claim construction in a patent infringement lawsuit over hospital bed monitoring systems. Read more
Appeals court vacates $177m Covidien award in spat with J&J

A federal appeals court today overturned the $177 million awarded to Covidien last year in its long-running patent infringement battle with Johnson & Johnson’s Ethicon Endo-Surgery subsidiary.
Judge Janet Bond Arterton had ruled that Ethicon Endo-Surgery infringed 6 claims in 3 patents held by Covidien’s corporate predecessors, Tyco Healthcare and U.S. Surgical Corp., with products including its Autosonix and LCS ultrasonic scalpels (Covidien’s competing products include its Harmonic Shears, according to the court documents). BMC Medical claims win in patent spat with ResMed

BMC Medical and its U.S. distributor, 3B Medical, today claimed a legal win over respiratory rival ResMed in a German court, part of their global war over sleep apnea devices.
The 1st District Court of Munich ruled that there is a “high possibility, that the patent in suit is not valid” in the dispute over a constant positive airway pressure device with a detachable water tank, BMC claimed. Read more
Ex-ArthroCare CFO wants a new trial too

Former ArthroCare CFO Michael Gluk, convicted for his part in a scheme estimated to have cost investors more than $750 million and sentenced to 10 years in prison, yesterday joined former ArthroCare CEO Michael Baker’s motion for a new trial.
Baker was sentenced August 29 to 20 years and former ArthroCare CFO Michael Gluk drew 10 years from Judge Samuel Sparks of the U.S. District Court for Western Texas. Read more
