TAVI: Medtronic vows to appeal CoreValve ban in patent loss to Edwards Lifesciences

Medtronic headed straight to the Federal Circuit Court of Appeals this week after a lower court ruled in favor of arch-rival Edwards Lifesciences, banning U.S. sales of Medtronic’s CoreValve transcatheter aortic valve implantation system.
The Federal District Court of Delaware ruled on Friday that the CoreValve device infringes on Edwards’ patents, and the judge issued an order banning Medtronic from selling or offering to sell the CoreValve system in the U.S. At Medtronic’s request, the judge stayed the order for 7 business days to give the company time to “seek prompt relief” from a higher court. U.S. District Judge Gregory Sleet chided Medtronic this week after issuing a preliminary ban on the medtech titan’s CoreValve transcatheter aortic valve implantation system.
Judge Sleet wrote that Medtronic willfully sidestepped the law in bringing the device to market. He ruled late last week in favor of Edwards Lifesciences, granting an injunction to limit Medtronic from selling the devices in the U.S. Read more
Plaintiffs look to remove pelvic mesh cases to Pennsylvania state court

A group of plaintiffs who are suing Boston Scientific, Johnson & Johnson, Secant Medical and other pelvic mesh makers want a federal judge to send their cases back to a state court in Philadelphia.
Boston Scientific, J&J’s Ethicon subsidiary, C.R. Bard, Endo Health Solutions, Cook Medical and Coloplast are facing thousands of product liability and personal injury lawsuits over their respective pelvic mesh devices. Hundreds of cases have been consolidated into multi-district litigation under Judge Joseph Goodwin of the U.S. District Court for Southern West Virginia. Read more
Appeals court vacates ban on Boston Scientific's Guidezilla catheter

A federal appeals court overturned ban on U.S. sales of the Guidezilla catheter made by Boston Scientific today in a patent infringement lawsuit filed by Vascular Solutions.
The suit alleges that the Guidezilla catheter “is a copy of VSI’s GuideLiner catheter. Guidezilla’s design, materials, and dimensions are materially the same as those of GuideLiner and those described and claimed in the patents-in-suit,” according to court documents. Read more
Judge tosses latest Zoll suit against Philips

A federal judge yesterday tossed a patent infringement lawsuit between defibrillator rivals Zoll Medical and Philips Healthcare, the latest development in their 4-year-old dispute over automated external defibrillator technology.
Philips, the Dutch conglomerate whose healthcare division is based in Andover, Mass., sued its neighbor in nearby Chelmsford in June 2010, alleging infringement of 15 AED patents. Zoll countered with a lawsuit of its own a month later, accusing Philips of infringing 5 Zoll AED patents. The cases were later consolidated, according to court documents. Read more
