Dr. Joseph Kubacki
Florida man and former university professor Dr. Joseph Kubacki was convicted of 150 counts health care fraud, wire fraud and making false statements in health care matters in relation to Medicare and private health insurance billings that raked in more than $4.5 million.
Kubacki, 62, was the chairperson of the ophthalmology department at Temple University School of Medicine, where he also serviced as assistant dean.
Between 2002 and 2007 Kubacki filed thousands of false claims for services rendered to patients that he did not personally see or evaluate, according to an FBI release.
He made notations in patient charts and filed fee slips indicating that he had conducted personal evaluations, even though he was not involved and occasionally out of state when the patients were seen by other physicians.
A sentencing hearing hasn’t yet been scheduled.

Advanced Cell Tech sued for $12.4 million
Advanced Cell Technology Inc. (OTC:ACTC) is under fire from an investor who claims the company mislead him about a stock offering and that he purchased shares at an inflated price.
Shareholder Gary Aronson has been after the company ever since ACT defaulted on promissory notes, leading Aronson to sue, and win, in 2004.
Aronson’s new suit claims that ACT transferred its stock without the court’s permission, and he is seeking $12.4 million in damages, according to Law360.com (paid).
Masimo sues Philips over medical monitors
Masimo Corp. (NDSQ:MASI) filed a lawsuit accusing Philips Healthcare of infringing on patents for measuring blood oxygen levels with the IntelliVue line of noninvasive pulse oxymetry devices.
This latest suit is part of a longer history between the two companies, including another Masimo lawsuit against Philips two years ago, Law360.com reported.
The companies are also occasional partners. They announced last month that they had reached a long-term non-exclusive agreement to integrate Masimo’s rainbow SET technology into Philips Healthcare’s products.
