The 1st lawsuit in what’s likely to be a long series filed against Johnson & Johnson (NYSE:JNJ) subsidiary DePuy Orthopaedics over its ASR metal-on-metal hip implant settled ahead of trial, according to court documents.
The case, Rundle et al vs. DePuy Orthopaedics, was slated to go before a jury Dec. 3 in Nevada’s 8th Judicial District Court.
No further details on the settlement were available. Peter Wetherall, a lawyer for lead plaintiff Anneliese Rundle, did not immediately return a call for comment.
A second trial is scheduled for January 2013 in Maryland’s Circuit Court for Prince George’s County.
Lawsuits over the metal-on-metal hips have piled up around the world. Hundreds of Australian patients joined a class action lawsuit that may top $200 million in damages.
