BD owes $340m to Retractable Technologies in anti-trust case

Becton Dickinson & Co. must pay $340 million to Retractable Technologies in their war with over safety syringe technology, a Texas federal judge ruled yesterday.
RTI alleged that BD made false claims in ads that its Integra, Safety-Lok, SafetyGlide and Eclipse safety syringes boast the “world’s sharpest needle” and about the amount of “waste space” RTI’s VanishPoint syringe. Read more
Feds indict Vascular Solutions, CEO over Vari-Lase

A federal grand jury yesterday indicted Vascular Solutions and CEO Howard Root, accusing them of running an off-label promotion scheme for its now-discontinued Vari-Lase varicose vein treatment.
Minneapolis-based Vascular Solutions said yesterday that it “vehemently” disagrees with the allegations and “will contest them vigorously,” noting that the Vari-Lase Short Kit brought in only $534,000 from 2007 to July 2014, when the company pulled it from the market. Read more
Federal jury begins deliberations in Boston Scientific mesh trial

A federal jury in Miami began today to weigh whether Boston Scientific is liable to 4 women who say they were injured by the company’s transvaginal mesh devices in 1 of the 1st federal trials in thousands of suits over the devices.
In closing arguments at the end of the eight-day trial, Shelley Hutson, a lawyer for the women, said Boston Scientific rushed dangerous products to market without performing adequate testing to fully understand the risks they posed. Read more
Boston Scientific ordered to pay $26.7 million over mesh devices

Boston Scientific was ordered late yesterday to pay 4 women a total of $26.7 million after it was found liable for selling faulty transvaginal mesh devices, following 1 of the 1st federal trials resulting from thousands of lawsuits over the devices.
After deliberating for a few hours, a Miami federal court jury found Boston Scientific liable following an 8-day trial. Plaintiffs said they suffered injuries such as pain, bleeding and infection as a result of the company’s Pinnacle device, used to treat pelvic organ prolapse and stress urinary incontinence. Judge dismisses 76 Ethicon pelvic mesh lawsuits in Texas

A federal judge in Texas this week tossed 76 product liability lawsuits brought against JNJ Ethicon subsidiary over its Gynecare Prolift pelvic floor repair system, ruling that his court has no jurisdiction over the out-of-state plaintiffs.
Judge Kenneth Hoyt of the U.S. District Court for Southern Texas ruled that all but 1 of the plaintiffs in the batch of suits, originally filed in a Texas state court, had no standing in Texas. Read more
