Baxter drops FloSeal case against J&J

Baxter (NYSE:BAX) last week dropped a lawsuit it filed last year accusing Johnson & Johnson (NYSE:JNJ) of infringing patents covering its FloSeal hemostasis device.

Deerfield Park, Ill.-based Baxter asked the U.S. District Court for Northern Illinois to dismiss the case against J&J, its Ethicon subsidiary, Ferrosan Medical Devices and Packaging Coordinators with prejudice, according to an April 1 court filing.

Baxter sued the defendants in January 2014, alleging infringement of 6 patents covering the FloSeal line with J&J’s Ethicon SurgiFlo line of competing surgical hemostasis products.

In February 2014 Baxter also filed a complaint with the U.S. International Trade Commission, which opened an investigation in April 2014.

Baxter last week also filed a sealed motion with the ITC to end that probe, based on a confidential settlement agreement.
