
An Australian firm sued Thermo Fisher Scientific Inc. (NYSE:TMO) and a British supplier, accusing the lab instruments giant of infringing a patent for a device used to separate molecules.
NuSep Holdings Ltd. and its Bogart, Ga.-based subsidiary NuSep Inc. filed the lawsuit in the U.S. District Court for Northern Georgia, accusing Thermo Fisher, its Pierce Biotechnology subsidiary and their supplier Expedeon Ltd. of violating NuSep’s patent for a "Cassette for Electrophoresis Gels." Electrophoresis is a procedure that uses an electric current to separate molecules
such as proteins, DNA, or RNA fragments according to size and
electrical charge.
The lawsuit alleges that Expedeon infringes the patent with a cassette it makes, which it also provides to Thermo Fisher under Pierce’s private-label brand. The lawsuit seeks a judgment of infringement, a permanent injunction barring further infringement, triple damages, pre- and post-judgment interest and legal fees.
