MASSDEVICE ON CALL — Medical device giant Medtronic (NYSE:MDT) this week asked a Massachusetts federal judge to dismiss a lawsuit accusing the company of off-label marketing of its insulin pumps.
The Minnesota-based device maker argued that the prosecution, led by former sales rep Adam Witkin who turned whistleblower last year, failed to demonstrate that any off-label marketing activities caused harm to Medicare or Medicaid, Law360.com reported.
Medtronic argued Witkin’s case lacks concrete examples in which improper claims were taken to the government for reimbursement, according to the legal news site.
Medtronic in September 2012 revealed a year-old Dept. of Justice probe into the company’s insulin pump replacement practices.
