J&J demands $7.2 billion from Boston Scientific as trial begins

Boston Scientific should pay Johnson & Johnson $7.23 billion in damages and interest for breach of contract, nearly 9 years after Boston Scientific won a controversial bidding war for device maker Guidant, lawyers for J&J told a U.S. federal judge today.
“To be blunt about it, Guidant cheated – and then it lied to Johnson & Johnson so Johnson & Johnson would not discover what Guidant had done,” attorney Harold Weinberger said at the start of a non-jury trial in Manhattan federal court. Read more
Bard still on the hook for its share of $5m pelvic mesh verdict

C.R. Bard is still on the hook for its portion of a $5 million verdict in the 1st product liability trial over its Avaulta pelvic mesh, a California appeals court ruled yesterday.
A California jury in 2012 found for plaintiff Christine Scott and her husband, who sued in 2009 after a surgical procedure intended to treat occasional urinary incontinence left her entirely incontinent, in chronic pain and unable to have sex. Read more
Boston Scientific to pay $18.5m in pelvic mesh case

Boston Scientific was ordered today to pay $18.5 million for injuries caused by transvaginal mesh devices, a plaintiffs’ lawyer said, in the 3rd courtroom loss for the company over the products.
A jury in West Virginia federal court found the Massachusetts company liable to 4 women following a 10-day trial, according to their lawyer, Doug Monsour. The company was ordered to pay each of the 4 women damages ranging from $3.25 million to $4.25 million for the injuries. Read more
Justice Dept. recoups $6B in False Claims Act cases

The U.S. Justice Dept. said it recouped a record $5.69 billion in settlements and judgments from False Claims Act cases during the fiscal year ended Sept. 30, including some $2.3 billion in recoveries from healthcare cases.
It’s the 1st time FCA cases have exceeded the $5 billion mark, the Justice Dept. said, noting that it’s recovered $22.75 billion in FCA cases since January 2009 – nearly half of all recoveries logged since the act was amended 28 years ago. Read more
