Syneron Medical (NSDQ:ELOS) dropped a patent infringement lawsuit against EndyMed Medical and its distributor, Eclipse Aesthetics, after EndyMed agreed to stop selling its fractional skin resurfacing products in the U.S.
EndyMed will continue to re-supply electrodes and other maintenance items for the products it has already sold, according to a press release.

MASSDEVICE ON CALL — Pharmaceutical management services giant Express Scripts Holding Co. sued accounting firm Ernst & Young, claiming that an E&Y employee sneaked into Express Scripts offices to steal trade secrets.
Express Scripts fingered Don Gravlin, a partner at E&Y, for the alleged misconduct, saying Gravlin and the company "were possessed with an evil motive" in stealing more than 20,000 pages of pricing information, projections and other confidential data, according to the legal complaint.

MASSDEVICE ON CALL — New Jersey cardiologist Dr. Shashi Agarway last week admitted to collecting more than $100,000 in kickbacks for referring patients for imaging diagnostic exams.
Agarway pleaded guilty to referring patients for MRI and computed tomography scanning at Orange Community MRI in exchange for cash. He told regulators that he received $100 for each Medicare or Medicaid patient he referred for MRI scanning and $50 for each CAT scan.
